• Unless expressly stated with the offer, an advertised price does not include government fees and taxes, any finance charge, any dealer document preparation charge, any electronic filing charge, or any emission testing charge
• An offer may apply only to specific vehicles identified by stock number or vehicle identification number, and quantities may be limited
• Offers may not be combined with any other discount, incentive, or promotion unless expressly stated
• Every offer expires on the date stated with the offer, and manufacturer programs may end or change without notice

Vehicle Images and Visual Materials

Images on this website come from more than one source and are provided for general illustration only. Unless expressly labeled otherwise, they are not photographs of a specific vehicle in inventory.

• Vehicle interior images in our model galleries are manufacturer press and media materials, reproduced to identify and describe the vehicles we offer; all such images remain the property of their respective manufacturers and are used with attribution and without any claim of ownership
• Exterior, promotional, and lifestyle visuals may include manufacturer press and media materials, images obtained from third-party image sources, and digitally created or digitally edited artwork; where any such image belongs to a manufacturer or other rights holder, it remains their property

Recording of Communications

We may monitor or record telephone calls and retain text messages and email exchanged with you, for quality assurance, training, dispute resolution, and recordkeeping. Where notice or consent is required before recording, we will give that notice at the beginning of the call, and you may ask us not to record. Recordings and message records are retained as described in our Privacy Policy.

Payment Terms and Financing

Vehicle purchases, leases, rentals, and related transactions are subject to the applicable written agreement. General payment and financing terms include:

• All payments must be made according to the applicable written terms
• Financing applications are subject to credit approval
• Late or incomplete payments may result in additional charges where permitted by law
• We accept various payment methods including cash, bank transfers, and financing
• Tax, registration, and documentation fees are additional
• Sales terms, cancellation rights, and refund eligibility must be confirmed in writing

Vehicle Sales and Purchase Terms

Vehicle availability, price, condition, mileage, incentives, and specifications are subject to confirmation. Vehicle transactions may include the following terms:

• Vehicles are sold according to the written purchase or lease documents
• Vehicle condition, mileage, and equipment are verified to the best of our ability but must be reviewed before signing
• Buyers are responsible for inspecting the vehicle and documents before completing a transaction
• Trade-in values are estimates until final appraisal and acceptance
• Vehicle prices exclude taxes, registration, and documentation fees
• Delivery and pickup arrangements must be coordinated in advance

Deposits and Holds

A deposit or hold does not reserve a vehicle or lock in a price unless we confirm the specific vehicle, the amount, and the duration in writing. Whether a deposit is refundable, and the conditions for any refund, will be stated in the written receipt or agreement for that deposit. We will apply, refund, or retain a deposit only as stated in that writing and as permitted by California law.

Used Vehicles Sold As Is

Unless a written warranty or a service contract is provided with the vehicle, used vehicles are sold "as is," without any dealer warranty, and you assume the entire cost of any repairs after purchase.

• The Buyers Guide posted on the vehicle window is part of your purchase contract, and its terms override any contrary provision in the purchase agreement
• Where a used vehicle is sold with a written warranty or a service contract, the implied warranties required by the Song-Beverly Consumer Warranty Act apply and are not disclaimed
• Any manufacturer warranty that remains on a used vehicle is provided by the manufacturer, not by ENA Motors, and is subject to the manufacturer's terms
• You have the right to have the vehicle inspected by an independent mechanic of your choosing before you buy

Vehicle History and Third-Party Reports

Vehicle history reports, odometer readings, inspection reports, window stickers, and specification data are prepared by third parties or reported by prior owners, and we pass them through as we received them.

• We do not independently verify and do not guarantee the accuracy or completeness of third-party reports and data
• We are not responsible for information that a third party, prior owner, or reporting agency failed to record or report
• We disclose material facts known to us about a vehicle as required by law
• You are responsible for inspecting the vehicle and its documents, and may obtain an independent inspection, before completing a purchase

Trade-In and Valuation Estimates

Any valuation, trade-in estimate, or payment estimate generated on this website is an automated, non-binding estimate based solely on the information you enter. It is not an appraisal, not an offer to purchase, and not a guarantee of value. Actual trade-in value is determined only after physical inspection of the vehicle, verification of title, mileage, and any payoff amount, and delivery of our written offer, and it may differ substantially from any estimate shown on this website.

Test Drives and Demonstration Vehicles

To test drive a vehicle you must present a valid driver's license and, where we require it, proof of insurance.

• You agree to operate the vehicle lawfully and safely and to observe any route, distance, or time limits we set
• Only the person we have authorized may operate the vehicle, and you may not allow anyone else to drive it
• You are responsible for any citation, toll, or penalty incurred during your use of the vehicle
• To the extent permitted by law, you are responsible for loss or damage caused by your unlawful, prohibited, or negligent use

Vehicle Rental Terms

Short-term rentals are governed by the separate written rental agreement you sign, which controls over this section. In general:

• The renter must meet our minimum age, driver's license, and insurance requirements
• Only drivers listed and authorized on the rental agreement may operate the vehicle
• The vehicle may not be used for hire, for racing or off-road use, for towing, while the driver is under the influence, or outside any geographic limit stated in the rental agreement
• The renter is responsible for fuel, tolls, citations, impound charges, and related administrative fees
• The renter is responsible for loss of or damage to the vehicle as set out in the rental agreement and as permitted by California law
• We may recover the vehicle where the rental agreement or applicable law allows it

Service Work and Service Warranties

Maintenance, repair, window tinting, body repair, and related services are subject to separate written service authorizations. General service terms include:

• Service work is performed with reasonable care and skill
• Parts and labor warranties vary by service type and are stated in the applicable service documents
• Customers are responsible for service authorization and approval
• Service quotes are estimates and may vary based on actual work needed
• Emergency repairs may require additional authorization
• All vehicles must be picked up within 30 days of service completion

Uncollected Vehicles and Storage

If a vehicle is not collected within 30 days after we notify you that service is complete, we may charge reasonable storage at our posted rate from that date, and we may exercise any lien or other remedy available to us under California law after giving the notice that law requires. Before taking any such step we will attempt to reach you using the contact information you provided, so please keep it current.

Disclaimer of Warranties

THIS WEBSITE AND ITS CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. We do not warrant that this website will be uninterrupted, secure, or error-free, or that its content is accurate, complete, or current.

• This section applies to your use of this website and its content only
• It does not limit, disclaim, or modify any warranty that applies to a vehicle or to service work under a signed agreement, a manufacturer warranty, a service contract, or applicable law
• Nothing in these terms waives any implied warranty or other right that cannot be waived or limited under California law, including the Song-Beverly Consumer Warranty Act

Limitation of Liability

To the maximum extent permitted by law, ENA Motors Inc. and its officers, employees, and agents are not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, including lost profits, lost revenue, lost data, or loss of use, arising out of or relating to this website or our services, whether based in contract, tort, or any other theory, and whether or not we were advised of the possibility of such damages. Our total aggregate liability arising out of or relating to this website or a specific service is limited to the amount you actually paid to us for the specific service giving rise to the claim. Dispute Resolution

• Informal resolution first: before starting arbitration, you agree to notify us in writing at enamotors@yahoo.com describing the dispute, and to give us thirty (30) days to resolve it in good faith
• Individual binding arbitration: any dispute not resolved informally will be settled by binding arbitration, administered in Los Angeles County, California, under the administering organization's rules for consumer disputes
• Arbitration costs: ENA Motors will pay all arbitration filing and administrative fees that exceed what you would have paid to file the same claim in court
• Class action waiver: disputes will be arbitrated only on an individual basis, and you and ENA Motors each waive any right to bring or participate in a class, collective, consolidated, or representative action
• Small claims exception: either party may instead bring an individual claim in small claims court if the claim qualifies
• Your right to opt out: you may reject this arbitration agreement by emailing enamotors@yahoo.com with the subject line "Arbitration Opt-Out" within thirty (30) days after you first accept these terms; opting out does not affect any other part of these terms
• Claims for public injunctive relief are not subject to arbitration and may be brought in court
• Nothing in this section limits any right or remedy that cannot be waived under California law, and if the class action waiver is found unenforceable as to a particular claim, that claim will proceed in court

Governing Law

These Terms of Service are governed by and construed in accordance with the laws of the State of California, without regard to conflict of law principles. Subject to the Dispute Resolution section above, any legal action or proceeding shall be brought exclusively in the state or federal courts located in Los Angeles County, California, and you consent to the jurisdiction of those courts.

General Provisions

• Severability: if any provision of these terms is found unenforceable, that provision will be limited or removed to the minimum extent necessary, and the remaining provisions will stay in full force
• Entire agreement: these terms and our Privacy Policy are the entire agreement between you and ENA Motors regarding this website, and are superseded by any signed purchase, lease, rental, or service agreement as to that transaction
• No waiver: our failure to enforce any provision is not a waiver of our right to enforce it later
• Assignment: you may not assign these terms without our written consent; we may assign them in connection with a merger, acquisition, or sale of assets
• Force majeure: we are not liable for any delay or failure to perform caused by events beyond our reasonable control
• Survival: the sections on intellectual property, disclaimers, limitation of liability, indemnification, dispute resolution, and governing law survive termination

Electronic Records and Signatures

You consent to receive documents, disclosures, and notices from us electronically, and to sign documents electronically where we offer that option and the law permits it.
